Robert Zarco, Founding Partner of Zarco Einhorn Salkowski & Brito, P.A., has made an indelible mark on the community, clients, and the Franchise Law practice. Mr. Zarco, also known as the Franchise King, has been at the forefront of protecting the legal rights and interests of franchisees and other commercial business clients, nationally and internationally, for over 35 years. His gift for thinking outside the box, and courage to follow through with his creative legal arguments and strategies has helped him and his very talented team of experienced attorneys, formerly accountants, economists, and bankers, to establish important legal precedents in both U.S. Federal and State Courts. As a gifted commercial Trial Lawyer, Robert and his team are known for their keen ability to connect with clients and help resolve their complex business disputes between parties with immense precision, including Mediation, Arbitration, and Litigation as needed.
Robert Zarco was awarded the Lifetime Achievement Award in Total Quality Franchising by the American Association of Franchisees and Dealers (AAFD), Fellow and Order of Centurion by the Litigation Council of America Trial Lawyers Honor Society, Best Lawyer of the Year in 2020 by Best Lawyers in Franchise, and Super Lawyers for over 15 years, among many other accolades. The Firm, of which he is a founding partner, represents franchisees from over 500 brands in more than 40 states and 20 countries, is considered a National Tier 1 Law Firm in Franchise Law by Best Lawyers as published in US News & World Report.
When asked about his success as a Trial Lawyer, Zarco responded “Trials are expensive for clients and often uncertain in their outcomes. For this reason, and for the sanctity of relationships, I often work to resolve disputes between parties outside of the courtroom unless absolutely necessary. We have had many positive results for numerous clients where the settlement terms and named parties are confidential, unfortunately.” The resolution of complex business disputes most often many in Franchise Law representing franchisees, and other small to mid-sized business clients can involve substantial sums. Last year, two cases exceeded $5 million settlements. Several in the $1million -$5 million range involved over 100 plaintiffs in arbitration, others from pre-trial settlements, many from post demand letters, and the remainder from confidential mediation settlements.
Mr. Zarco believes that to achieve success in his business, as with many others, there is no substitute for the 3 P’s: Preparation, Persistence and the attempt to achieve Perfection. He shared that the most significant change in commercial law over his career is the increasing sophistication and business experience of franchisees and other small business clients, requiring to engage them early and more often in legal decisions with business consequences. An interesting fact that few know about the firm he founded over 30 years ago, Zarco Einhorn Salkowski & Brito, P.A., is that “We are one big family, working together as a team for the mutual benefit of each other and for clients: One for All and All for One!” The firm just celebrated its 30th Anniversary in what is arguably known as the ‘Party of the Year!’
Robert Zarco was born in Cuba, but was forced to flee the country at the age of two with his family in 1961 in order to escape communism. From starting his own landscape business at the ripe age of seven, to becoming a founding partner of one of the premier commercial law firms in the country, his parents’ sacrifices, combined with his ambition and determination, has led him to appreciate the value of hard work and accomplish great things. He has strong conviction in helping the underdog and giving back. For this reason, Mr. Zarco is also a passionate community leader and philanthropist, having served on the Board of Trustees for the Public Health Trust/Jackson Health System, as well as in the University of Maryland Board of Trustees. He supports many charitable causes that are dear to his heart, such as The Jewish Federation, AIPAC, Rambam Hospital in Israel, Israel Bonds, among many others.
On his personal time, Mr. Zarco is an avid yachtsman who loves boating, cooking as an amateur chef, and hosting parties and fundraisers for many great causes. Mr. Zarco loves to collect automobiles and displays his new art collection at the law firm’s luxurious new offices in Downtown Miami. Together with his family and three grown children and grandchildren, Mr. Zarco loves to travel and lives his life to the fullest. He truly lives by the mottos he cherishes most: “Work hard, Play hard” and “Live, Love, Learn, and Laugh”.
