In a sobering turn of events, Southwest Airlines has resolved the lawsuit filed by the family of Gaby Assouline, a 25-year-old passenger who met a tragic fate during a flight. The family’s attorney, Robert Solomon, confirmed the settlement, opting not to disclose the specific amount.
Gaby Assouline, dealing with a genetic muscle disorder, sought assistance from a Southwest Airlines employee during her journey from Fort Lauderdale to Denver in February 2022. The lawsuit claimed that their request for help was denied, forcing Gaby to navigate the jet bridge independently.
The distressing incident resulted in Gaby being thrown from her wheelchair, causing severe injuries that left her paralyzed from the neck down. After 11 challenging months, Gaby Assouline passed away in January 2023.
Nicholas Gerson, a seasoned personal injury attorney in Miami, suggested that the settlement likely reached seven figures, considering the circumstances of the case. Gaby’s mother, Sandra Assouline, shared the grim aftermath of the incident, detailing her daughter’s reliance on a feeding tube and loss of speech.
Southwest Airlines, expressing condolences to the Assouline family, maintained their stance that Gaby had declined an offer of assistance. The settlement, while providing closure, underscores the complexities and responsibilities involved in ensuring the safety of passengers during air travel. Beyond the financial aspects, this case serves as a stark reminder of the need for vigilance and empathy in addressing the unique needs of passengers.
