Tis the season to be jolly, yet jolly Madonna is not, thanks to a verbal skirmish with the co-op board at her Central Park West apartment building.

Madonna, who was inducted into the Rock and Roll Hall of Fame in September, is suing for breach of contract, breach of fiduciary duty, and injunctive relief. The apartment co-op, the management company, and a neighbor are named as defendants. The lawsuit is being filed because Madonna had been blocked from purchasing an apartment in the same building that is currently owned by Julie Clark Thayer.

Madonna hopes that the lawsuit will result in the block being lifted, as well as the payment of legal expenses.

Madonna, whose new album “Licorice” is set for release in early 2008, only filed a summons with notice as of Thursday, but by Friday, media outlets were reporting that she did in fact file suit.

She might want to remind the co-defendants that they are living in a material world.
